NOTICE TO LESSEES AND OPERATORS

Best Available Control Technology (Sulphur Dioxide)

This notice supersedes Notice to Lessees and Operators (NTL) 94-04, dated May 6, 1994, and amends the title, updates the cited regulatory authorities, and includes a statement regarding the Paperwork Reduction Act of 1995.

The Federal regulation 30 CFR 250.303(g) requires that the projected emissions of any air pollutant from a facility described in an Exploration Plan, Development Operations Coordination Document, or Development and Production Plan be reduced through the application of best available control technology (BACT) if the projected emissions are determined to significantly affect the air quality of an onshore area. In complying with this requirement, I hereby verify, in accordance with the authority granted by 30 CFR 250.302, that the use of diesel fuel with a sulphur content of 0.05% or less represents a BACT for the control of the emission of sulphur dioxide when diesel engines are used to construct or operate the subject facility.

Paperwork Reduction Act Statement

The information collection provisions of this notice are intended to provide clarification, description, or interpretation of requirements contained in 30 CFR 250, Subparts B and C. The Office of Management and Budget (OMB) has approved the information collection requirements for these regulations and assigned OMB Control Numbers 1010-0049 and 1010-0057, respectively. This notice does not impose additional information collection requirements subject to the Paperwork Reduction Act of 1995.
